Ch. 91 Waterways Appeal - Recommended Final Decision
/We have some "bad" and yet completely expected news to share with you. On Friday, December 20th we received the decision from the MassDEP OADR regarding the Ch. 91 Waterways appeal. Unsurprisingly, they decided against us and for Enbridge and the DEP.
We are sure that you are shocked, but we did not want to give you bad news before the Holidays! We also had to ask Mike Hayden a couple of clarifying questions before we shared this with you. (And we hope you enjoyed your holidays!)
Attached please find the Recommended Final Decision on Remand. But don't stress--it ain't over 'til it's over. And it ain't over! We must wait for the Commissioner to put the final signature on this mess and then we will head back to court.
We do want to make one comment on the present political climate with regards to environmental justice cases. We are going into the Dark Ages with the upcoming federal administration. We are not sure what will become of our legal rights to challenge the Evil Gas and Petroleum Empire. But we will persevere as always. We believe that it is more important than ever to show up and stand up for what is right and just. We know you believe that, too. We feel compelled to require that our state officials do the same and will not back down from our work to stop the compressor from operating.
